Site Credits
All text, photos, videos and other content on this website is the exclusive copyright of Index Title Company, Inc. dba Picture Studios unless otherwise indicated. By uploading content to our website, you grant Picture Studios (and any entity authorized by Picture Studios) a royalty-free, world-wide, perpetual, non-exclusive license to publicly display, distribute, reproduce and create derivative works of the entries, in whole or in part, in any media now existing or later developed, for any purpose, including, but not limited to: advertising and promotion of the company, sponsors, clients, or affiliates as well as websites, social networks, desktop software, mobile apps and web applications. Any photograph reproduced by Picture Studios or authorized parties will include a photographer credit to the extent such credit is feasible. Picture Studios will not be required to pay any consideration or seek additional approval in connection with such uses.
Services Provided
Picture Studios provides studio space and equipment to take photos or shoot videos. Customers can gain access to the studio for their projects by scheduling time(s) with our online booking system.
Rental Agreement
Picture Studios hereby rents to Person or Company name that appears on the Studio Request, which is identified in this agreement as [“RENTER”] and RENTER hereby rents and accepts from Picture Studios all of the items of EQUIPMENT and SPACE identified by agents or employees of Picture Studios during the check in process [the “STUDIO”]. The person reserving the studio MUST check in at the office in person and show a valid government issued ID and the credit card used for the rental. The term of this Rental Agreement commences on the check in date and ends when the STUDIO is returned in good condition and repair to Picture Studios. It is the obligation of RENTER to arrange for the receipt and return of all EQUIPMENT, and all such use is at the sole risk and expense of RENTER.
The rent for the STUDIO is the amount set forth in the confirmation email following a studio request by the RENTER. Picture Studios shall be entitled to immediate payment of all Rentals before issuance of the STUDIO being rented. Additional charges for late returns will be charged at the conclusion of the Rental Term. Charges for lost, stolen, or damaged EQUIPMENT and SPACE will be assessed and charged to the credit card file once the appropriate charge is determined. The price, terms, conditions and availability of the STUDIO are all subject to change without notice. Picture Studios rental prices are based on the premise that the renters are experienced and well trained. Our gear is professional equipment and is not recommended to the inexperienced. Failure to understand the equipment operation is not an excuse for non-payment!! Payment in full is due at the time of the studio request and is considered final unless cancelled with 24 hours prior notice. Cancellations with less than 24 hour notice are subject to a cancellation fee equal to the full amount of the rental rate.
RENTER agrees that it has or will inspect the EQUIPMENT not later than its delivery of possession to RENTER and that it shall be conclusively presumed that RENTER has fully inspected the EQUIPMENT, is satisfied and has accepted the EQUIPMENT in good condition and repair.
PICTURE STUDIOS MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION, THE CONDITION OF THE EQUIPMENT, ITS MERCHANTABILTY OR ITS FITNESS FOR ANY PARTICULAR PURPOSE. PICTURE STUDIOS SHALL NOT BE RESPONSIBLE FOR ANY LOSS OF DATA DUE TO EQUIPMENT MALFUNCTION OR OTHERWISE NOR FOR THE LOSS OF ANY DATA THAT IS STORED ON ANY MEDIA STORAGE DEVICES.
The STUDIO is and shall always be and remain, the sole and exclusive property of Picture Studios, and RENTER shall have no rights therein except as expressly set forth herein. Law Enforcement Authorities will be notified if at the sole discretion of Picture Studios, THEFT by the RENTER is determined to have occurred. The RENTER is determined to have committed THEFT if the EQUIPMENT or other property at the STUDIO has not been returned to Picture Studios within 15 minutes of following the conclusion of the studio session. If at any time Picture Studios has any reasonable cause to believe that the RENTER intends to commit THEFT proper Law Enforcement Authorities will be notified irregardless of the amount of time that has elapsed.
RENTER hereby assumes and shall bear the entire risk of loss or damage to the EQUIPMENT from any and every cause whatsoever. No loss or damage to the EQUIPMENT or any part thereof shall release any obligation under this rental agreement, which shall continue in full force and effect. RENTER is responsible for the return of all EQUIPMENT and SPACE in the same condition as delivered. In the event of any loss or damage of any kind whatsoever to the STUDIO, RENTER shall (a) restore it to good condition and repair or replace it with like EQUIPMENT and SPACE acceptable to Picture Studios, in good condition and repair, or (b) if in the reasonable judgment of Picture Studios any item of EQUIPMENT is determined by Picture Studios to be lost, stolen, destroyed or damaged beyond repair, pay Picture Studios the full replacement value thereof.
RENTER agrees to indemnify and hold Picture Studios harmless from and against any and all claims, actions, suits, proceeding, costs, expenses, damages and liabilities, including reasonable attorney’s fees arising out of, connected with, or resulting from the use of the STUDIO. Each party agrees to give the other the prompt notice of any such claim or the institution of any action, suit or proceeding. RENTER shall reimburse Picture Studios for all costs and expenses, including reasonable attorney’s fees incurred by Picture Studios in exercising any of its rights or remedies or enforcing any of the terms, conditions or provisions of this agreement.
No covenant, term or condition of this Rental Agreement can be waived except by the written consent of Picture Studios. Forbearance, indulgence or the failure to insist on the terms hereof by Picture Studios in any regard whatsoever shall not constitute a waiver of the covenant, term or condition to be performed by RENTER to which the same apply and until complete performance by RENTER of said covenant, term or condition. Picture Studios shall be entitled to invoke any remedy available to Picture Studios under this Rental Agreement or by law or in equity despite said forbearance, indulgence or the failure to insist on strict compliance with the terms hereof.
Privacy Policy
Customer personal data will be available to Picture Studios. Personal data includes mandatory information such as a Name, an email Address, a Billing Address and a Telephone Number.
Personal data provided by the user may be used by agents, employees and affiliates of Picture Studios to notify the user of any news, and or promotional offers relating to the www.picturestudios.com website. The user can unsubscribe from these notifications at anytime.
Picture Studios will not disclose user personal data to an unrelated third party without providing prior notice on this website.
Website Use
Picture Studios may not be used for any of the following purposes:
- To contact Picture Studios customers about a competing service.
- To contact Picture Studios website users to offer any services from a 3rd party company.
- To post any illegal content or engage in any unlawful or unethical activity.
The user is required to provide truthful information in their communications or studio requests.
It is prohibited to use any text or images from www.picturestudios.com for personal or commercial use.
User Information
Picture Studios does not hold responsibility for any untruthful and/or inaccurate information appearing on this website and reserves the right to edit or delete any information submitted by any user.
Liability
Picture Studios will not be responsible for any loss or damage the user may encounter from using the website.
